Formazione per lavoratori in materia di salute e sicurezza sul lavoro
Nel 2012 uno specifico Accordo Stato-Regioni ha fissato i contenuti e il monte-ore necessario che deve essere somministrato a qualunque lavoratore adibito ad attività lavorativa, come previsto dagli Artt. 36-37 del D.Lgs. 81/2008, non fissando però competenze specifiche per il docente.
Il 18 aprile 2014, però, in Commissione consultiva permanente, sulla base del documento elaborato nel Comitato speciale n. 5, sono stati stabiliti i «Criteri di qualificazione della figura del formatore per la salute e sicurezza sul lavoro, anche tenendo conto delle peculiarità dei settori di riferimento», ai sensi dell’art. 6, comma 8, lett. m-bis) del D. Lgs. n. 81/2008 e s.m.i..
In tale sede la Commissione stabiliva una deroga per due anni che garantiva la possibilità per i datori di lavoro, a prescindere dai requisiti personali di competenza posseduti, di svolgere formazione ai propri lavoratori, purché avessero frequentato il corso per RSPP.
Dal 18 aprile 2016 non è più applicabile la suddetta deroga per docenze in tema di Salute e Sicurezza sul lavoro e il docente di tali corsi dovrà possedere le competenze fissate dalla suddetta Commissione.
